Terms of use
The short version: Passive Action is free information, not legal advice. Check every detail on the official settlement website, never pay anyone to file a claim, and only file where you really qualify.
Agreeing to these terms
By using Passive Action, you agree to these terms and to our privacy notice, including the use of cookies it describes. If you don't agree, please don't use the site. Passive Action is run by the operator of Passive Action.
What this site is
Passive Action is a free, independent directory of class action settlements and related public records. We are not a law firm and don't give legal advice. Using the site, emailing us or reading anything here doesn't create an attorney-client relationship. We are not affiliated with any court, settlement administrator, law firm or defendant, and we never file a claim for you.
Accuracy
Everything about a settlement comes from third parties: court records, published settlement notices, official settlement websites and public listings. We share it as it is, for general information only. It can be incomplete, out of date or wrong, and deadlines and eligibility can change at any time. Always confirm that you qualify, and check the deadline, on the official settlement website before you act.
Filing a claim
Filing a claim is always free: official claim sites never charge a fee, so never pay anyone to file for you. Claim forms are usually signed under penalty of perjury, so only file where you actually meet the class definition. You alone are responsible for the claims you file and what you say in them.
Using the site fairly
You may use the site for your own personal, non-commercial purposes, and link to any page. Please don't:
- copy the site's listings in bulk, or scrape, crawl or mirror the site with automated tools, except search engines following our robots.txt;
- try to get around our security, rate limits or access controls, or disrupt the site for others;
- use the site for anything unlawful, to mislead people, or to pretend to be us or anyone else.
We may block access from anyone who does.
Email updates and other features
Email updates are free and go only to people who ask for them. Every email has a one-click unsubscribe link. Summaries made by the "Analyze online news & media" button are written automatically from what is published online and can be wrong. If a comments box is shown, comments are public and are run by Disqus under its own terms: never post a claim ID, PIN, address or anything from a claim form.
Donations are voluntary, are not a fee, and have nothing to do with any claim. If we offer paid features, the price and what is included are shown before you pay, payment is handled by Stripe under its own terms, and you can cancel at any time.
Links and ads
The site links to official settlement websites, courts and other sites we don't control, and we are not responsible for their content, privacy practices or availability. Ads are provided by Google and are not endorsements.
The software
The software that runs Passive Action is free software, released under the GNU General Public License, version 3. That license covers the code. The settlement information shown on the site comes from the public sources it names.
No warranty
In the spirit of the GPL, and to the extent the law allows, the site and everything on it are provided "as is", without warranty of any kind, express or implied, including any warranty that the information is accurate, complete or current, or fit for a particular purpose. The whole risk of relying on the information is yours.
Limitation of liability
To the extent the law allows, the operator of Passive Action is not liable for any damages arising from your use of the site or your inability to use it, including a missed deadline, a rejected claim or a lost payment, even if we were told such damages were possible. Some places don't allow these limits, so they may not apply to you.
Which law applies
These terms are governed by the laws of the State of Oregon and the federal laws of the United States that apply there, without regard to conflict-of-law rules. Nothing in these terms takes away any right you have under the consumer protection laws of the state where you live.
Changes to these terms
We may update these terms. When we do, we change the date at the top of this page. Using the site after a change means you accept the updated terms.
